Learned advocate appearing for the petitioner submits that petitioner is in custody for 3 years and 2 months and till date only 5 witnesses have been examined. According to the petitioner, the witnesses who have deposed till date did not implicate the petitioner. None appears on behalf of the State. Records of the case reflect that the prayer for bail of the petitioner was earlier considered in detail. None of the witnesses have been enclosed along with the bail application for independent consideration of this Court. There are other witnesses to be examined. The case is under Section 302/120B of the Indian Penal Code. 2 Having considered the gravity of the offence and the delay in the trial, I am of the opinion that delay itself cannot be the sole consideration. Accordingly, CRM (M) 1119 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
