Rakib (Allowed) CRM (NDPS) 1392 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Englishbazar Police Station case no. 353 of 2026 dated 11.03.2026 under Sections 21(C)/29 of the NDPS Act. And In the matter of : Sk Rafijul @ Sk Rafikul & Anr. ……Petitioners. Mr. P. K. Datta Mr. Santanu Deb Roy .....for the Petitioners. Mr. Sagar Saha Ms. Nayana Mukhopadhyay ……for the State. Learned advocate appearing for the petitioners submit that the petitioners have been implicated for alleged recovery of 15 bottles of phensedyl and is in custody since March, 2026. Learned advocate appearing for the State opposes the prayer for bail. Petitioners are in custody for a period of about three months. There has been no further recovery after the initial seizure. In view of the aforesaid, I am inclined to release the petitioners on bail on stringent conditions. As such, the petitioners, namely, Sk Rafijul @ Sk Rafikul and Mirja Alamin shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), 3rd Court, Malda. 2 If on bail, the petitioners shall meet with the investigation officer of the case once in a week till the submission of the charge- sheet. It would be the discretion of the learned Special Court either to continue with such condition or waived the condition after the period is over. Thus, CRM (NDPS) No. 1392 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. .All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
