Affidavit of service filed by the petitioner is taken on record. The Panchayat and the Zilla Parishad are not represented despite service. Learned counsel for the petitioner submits that the 9th and 10th respondents who are developers are raising construction without obtaining sanction from the concerned Panchayat and in violation of building rules. The petitioner submitted a representation in this regard before the concerned authority on 17th April, 2026 and seeks consideration of the same. Denying such allegation, learned counsel for the private respondents produces copy of permission for construction granted by the Additional Executive Officer, Howrah Zilla Parishad on 19th February, 2025 and submits that the construction is being raised in terms of sanctioned
2 building plan granted by the Zilla Parishad. In the event it is found that there deviations from the said plan, the respondents shall take necessary steps for regularization of the same. In view of the fact that the petitioner alleges violation of building rules by the private respondents and his representation submitted before the concerned authority in this regard is pending, the District Engineer, Howrah Zilla Parishad, being the 3rd respondent herein, is directed to consider and dispose of the same within four weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law. The parties shall be at liberty to produce relevant documents in support of their respective contention before the concerned authority at the time of hearing. The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
