The brief facts are these: The petitioner was selected and appointed as a Driver- cum-Conductor in the establishment of the Corporation. During the course of his service, he suffered a disability resulting in the amputation of his right leg. Taking note of his medical condition, the respondent Corporation assigned him light-duty work. However, the Corporation has subsequently directed the petitioner to undergo a fresh medical examination before the Medical Board. Aggrieved by the said communication, the petitioner has approached this Court seeking appropriate relief. - 3 - HC-KAR NC: 2026:KHC:34207 WP No. 22057 of 2025 3. Counsel for the respective parties urged several contentions. Counsel for the petitioner submitted that, since the petitioner's right leg has been amputated and the Corporation has already accommodated him by assigning light-duty work, there is no necessity to refer him once again to the Medical Board. Counsel for respondent Nos.1 and 2, on instructions, submitted that it is an admitted fact that the petitioner's right leg has been amputated. 4. Heard the arguments and perused the papers with care. 5. The photograph of the petitioner has been produced before the Court. A perusal of the same clearly indicates that the petitioner's right leg has been amputated, and the Corporation has also admitted the said fact. In such circumstances, there is no justification for insisting that the petitioner undergo a fresh medical examination by the Medical Board. - 4 - HC-KAR NC: 2026:KHC:34207 WP No. 22057 of 2025 Accordingly, the impugned letter dated 16.06.2025, produced at Annexure-J, is hereby quashed. The respondents are directed to continue assigning light-duty work to the petitioner without insisting upon a fresh medical examination or a second opinion from the Medical Board. 6. Accordingly, the writ petition is allowed. Because of disposal of the Writ Petition, interim order granted if any stands discharged and pending interlocutory applications if any are disposed of.
