Call for in proceeding in CC.No.750/2025 IN XXIV ACJM Bengaluru City on the file of the special court for Economic Offences, Bengaluru City. B. Allow the petition and thereby Quash, the Entire proceedings in CC.No.750/2025 IN XXIV ACJM Bengaluru city for the alleged offences punishable under Section 427, 380, 448, 504, 506 and 34 of Indian penal code now pending on the file of special court for Economic Offences, Bengaluru City in so far as these petitioners are concerned and thereby discharge the petitioners of all the charges and C. Grant such other and further reliefs deem fit under the circumstances of the case in the interest of justice and equity." 2. Heard Sri.Jayaraj Gowda M.N, learned counsel appearing for the petitioners, Smt.Waheeda M.M, learned HCGP appearing for respondent No.1, Sri.Raghavendra S.C, learned - 4 - HC-KAR NC: 2026:KHC:34117 CRL.P No. 8020 of 2025 counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a certified copy of Memorandum of Petition in M.F.A.No.7604/2025 and also Joint Memo in that regard. The Joint Memo reads as follows: “1. It is submitted that the respondent No.01 police have registered a case against them in Crime No.31/2024 dated 20-01-2024 for the alleged offences punishable under Section 427, 380, 448, 504, 506 and 34 of Indian penal code. 2. It is submitted that, this Hon'ble court has stayed the investigation in CC.No.750/2025 for the alleged offences punishable under Section 427, 380, 448, 504, 506 and 34 of Indian penal code now pending on the file of special court for Economic Offences, Bengaluru City and carried out by the respondent No.01 police disposal. 3. It is submitted that, the petitioners and Respondent No. 02 have settled in MFA.No.7604/2025 in view of the terms and condition of the said compromise petition the petitioners and Respondent No.02 agreed to close/Withdraw the case of in CC.No.750/2025 pending on the file of the Spl. Court of Economic Offences, Bengaluru initiated by the Respondent No.02 against the petitioner and the petitioners have agreed to close/Withdraw the case of in CC.No.751/2025 pending on the file of the Spl. Court of Economic Offences, - 5 - HC-KAR NC: 2026:KHC:34117 CRL.P No. 8020 of 2025 Bengaluru initiated by the petitioner No.01 against the Respondent No.02. 4. It is submitted that as per the settlement in MFA.No.7604/2025 the petitioners and Respondent No. 02 have filed this Join memo. 5. It is submitted that, the petitioners and Respondent covenants with each other to abide by aforesaid terms. Wherefore the petitioners and Respondent No.02 pray this Hon'ble court may be pleased to take this memo on record Allow the petition and thereby Quash the Entire proceedings in CC.No.750/2025 for the alleged offences punishable under Section 427, 380, 448, 504, 506 and 34 of Indian penal code now pending on the file of special court for Economic Offences, Bengaluru City in so far as these petitioners are concerned and thereby discharge the petitioners of all the charges in the end of the Justice.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5.
