ORAL ORDER
1. Accused in Crime No.91/2026 registered by Koramangala Police Station, Benglauru, for the offence punishable under Section 305 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.91/2026 was registered by Koramangala Police Station, Bengaluru, for the aforesaid offence against petitioner herein based on the first information dated 07.03.2026 received from Chintan Arora, who is the alleged victim in the present case. Petitioner was arrested in the present case on 23.04.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.4523/2026 was rejected on
20.05.2026. Therefore, he is before this Court.

Learned counsel for the petitioner submits that investigation is completed and charge sheet has been filed in the present case. In the other two criminal cases registered against the petitioner, he has been enlarged on bail. Petitioner

is a B. Tech student, who had lost his money in online gaming and it is under these circumstances, he has committed the alleged offence. Accordingly, he prays to allow the petition.
5. Per contra, learned HCGP, who has opposed the petition submits that petitioner is a habitual offender involved in two other criminal cases. In the event, he is enlarged on bail, he may indulge in committing similar offence. Accordingly, he prays to dismiss the petition.
6. The material on record would go to show that first informant and the petitioner herein were staying in the same room in "The Hood Hostel", V Block, Koramangala, Bengaluru. The allegation against the petitioner is that on 06.03.2026, he had committed theft of the mobile phone belonging to first informant and by using various mobile application and banking services available in the said mobile phone, he had totally spent a sum of Rs.3,97,437/-. It appears that petitioner has committed similar offence even in Telangana and in the said case, he was arrested and subsequently, under body warrant, he was produced before the jurisdictional Court in the present case and remanded to judicial custody on 23.04.2026.

Investigation of the case is now completed and charge sheet has been already filed. The alleged offences are triable by the Court of Magistrate and the maximum punishment for the same is imprisonment for a period of seven years.
7. Petitioner is said to be a B.Tech student and he has undertaken to abide by the conditions that may be imposed on him while enlarging him on bail. Considering the aforesaid aspects of the matter, I am of the opinion that his prayer for grant of regular bail, needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following
order:-
8. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.91/2026 registered by Koramangala Police Station, Benglauru, for the offence punishable under Section 305 of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties, out of which one shall be a local surety, for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
f) The petitioner is directed to appear before the Station House Officer, Koramangala Police Station, Bengaluru, between 10:00 a.m. and 02:00 p.m. on every second Sunday of the month and mark his attendance, for a period of one year.
