1 CGHC010267692026 2026:CGHC:29670 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 6280 of 2026 Ankit Sinha S/o Rajendra Sinha Aged About 28 Years R/o Village Bortara, Police Station And Tahsil Gurur District Balod (C.G.) ... Applicant versus State Of Chhattisgarh Through The Station House Officer, Police Station- City Kotwali Durg, District Durg (C.G.) ... Respondent For Applicant : Mr. Pushpendra Kumar Patel, Advocate. For Non-applicant/State : Mr. Jitendra Shrivastava, G.A. Hon'ble Shri Ramesh Sinha, Chief Justice Order On Board 14.07.2026 1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 198/2026, registered at Police Station - City Kotwali Durg, District Durg (C.G.) for the offence punishable under Sections 109 of the BNS 2023. 2. According to the prosecution, on 18.04.2026, at about 10:00 p.m., the VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.07.14 16:15:20 +0530 2 injured, Hemant Nirmalkar, had gone to Utai Tiraha, in front of Tempo Stand, Badala Hotel, Durg, for tea and snacks. At that time, the present applicant/accused, Ankit Sinha, allegedly arrived at the spot and, with the intention of causing his death, assaulted Hemant Nirmalkar with a sharp-edged knife, inflicting multiple injuries on his neck, chest, and abdomen. On receiving information about the incident, nearby persons immediately shifted the injured to the District Hospital, Durg, where he was administered first aid. Owing to the grievous nature of the injuries and excessive bleeding, he was thereafter referred to Shankara Medical College Hospital for better treatment and was admitted to the ICU. During the course of treatment, the injured disclosed to his family members, including his father, that it was Ankit Sinha who had assaulted him with a knife with the intention to kill him. On the basis of the written report lodged by the father of the injured, the police registered the FIR against the present applicant for the offences punishable under the relevant provisions of the Bharatiya Nyaya Sanhita, 2023, took up the investigation, prepared the spot map, recorded the statements of witnesses under Section 180 of the BNSS, seized the weapon of offence and other incriminating articles in accordance with law, and, after completion of the investigation, filed the charge-sheet before the competent Court. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case and has not committed any offence as alleged. It is further submitted that, on the basis of the material available on record, no prima facie case under Section 109 of 3 the Bharatiya Nyaya Sanhita is made out against the applicant. Learned counsel further contends that the medical evidence does not support the prosecution case, as the injuries sustained by the victim are not dangerous to life. It is also submitted that the applicant is a young person aged about 28 years, and his continued incarceration would seriously prejudice and jeopardize his future. The applicant is a permanent resident of the address mentioned in the cause title, there is no likelihood of his absconding or tampering with the prosecution evidence, and he is ready and willing to furnish adequate surety and abide by all such terms and conditions as may be imposed by this Hon'ble Court. On these grounds, it is prayed that the applicant be enlarged on bail. 4. Learned State Counsel opposed the bail application and submitted that the applicant made a murderous assault on the injured with a sharp-edged knife, causing multiple injuries on his neck, chest, and abdomen. It was further submitted that the injured sustained grievous injuries and had to be admitted to the ICU for treatment. The statement of the injured, along with the statements of the prosecution witnesses and the medical evidence collected during the investigation, prima facie supports the prosecution case. Considering the serious nature of the allegations and the material available on record, it was prayed that the bail application be rejected. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case, the submissions advanced by learned counsel for the parties, the nature and gravity of 4 the offence, and the material available on record, this Court finds that the applicant is alleged to have assaulted the injured with a sharp- edged knife, causing multiple injuries on the neck, chest, and abdomen. The medical evidence available on record indicates that the injuries sustained by the injured are dangerous to life, and he was required to be admitted to the ICU for treatment. Prima facie, the statement of the injured, duly supported by the statements of the prosecution witnesses and the medical evidence, establishes the involvement of the applicant in the commission of the alleged offence. Considering the seriousness of the allegations, the nature of the injuries, which have been opined to be dangerous to life, and the material collected during the investigation, this Court is not inclined to grant bail to the applicant. Accordingly, no case for grant of regular bail is made out, and the bail application is, accordingly, rejected. 7. Therefore, the bail application filed by the applicant/accused – Ankit Sinha involved in Crime No. 198/2026, registered at Police Station - City Kotwali Durg, District Durg (C.G.) for the offence punishable under Sections 109 of the BNS 2023, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/- (Ramesh Sinha) Chief Justice vaibhav
