Heard Mr. Ankush Borkar and Mr. Shashank Mishra, learned counsel for the petitioner as well as Mr. Vaibhav A. Goverdhan, learned counsel, appearing for respondent/CBI. 2. The present petition has been filed by the petitioner under Section 528 of the Bhartiya Nagrik Suraksha Sanhita read with Articles ROHIT KUMAR CHANDRA Digitally signed by ROHIT KUMAR CHANDRA 2 227 & 226 and Articles 14 & 21 of the Constitution of India with the following prayers :- “Under the facts & the circumstances of the case as stated by the Petitioner hereinabove & as is borne out from the documents placed on the record, this Hon'ble Court may graciously be pleased to set aside & quash the entire criminal proceedings against the Petitioner in the matter of CBI RC2182025A0014, dated 30.06.2025 registered u/s 61(2) of The BNSS, 2023 r.w. section 7, 8, 9, 10 & 12 of The P.C. Act, 1988 as amended by The P.C. (Amendment) Act, 2018 w.e.f. 26.07.2018 by the Superintendent of Police, ACB, CBI, & Head of Branch, Raipur u/s 154 of Cr.P.C., 1973 & in which the Report u/s 190 & 193(3) of The BNSS, 2023 has been filed by CBI on 30.08.2025 including the Regular Case RC2182025A0014, dated 30.06.2025 & the Report u/s 190 & 193(3) of The BNSS, 2023 has been filed by CBI on 30.08.2025 pending on the file of Ld. Special Judge, CBI Court, Raipur, Chhattisgarh & be further pleased to pass any other & further orders as this Hon'ble Court may be pleased to consider to be the fit & proper in the facts of the case. For which the applicant as in duty bound shall forever pray.” 3. During course of argument on 06.05.2026, learned counsel for the respondent/CBI has raised a preliminary objection that cognizance has already been taken by the concerned Court on 25.02.2026, but the same has not been challenged by the applicant in the present petition and accordingly, learned counsel for the petitioner prayed for and was granted time to amend the prayer for challenging the order taking cognizance dated 3 25.02.2026 and the matter was directed to be listed on 24.06.2026 and though the applicant had filed an application I.A. No. 02/2026, seeking said amendment, but as there were some procedural defect in the said application, therefore, on 24.06.2026, submitted that they does not want to press the application i.e. I.A. No. 02/2026 with liberty to file a fresh duly constituted amendment application. 4. 4. Today, when the matter is called out for hearing, learned counsel for the applicant further prays for time to file afresh duly constituted amendment application 5. From perusal of the prayers and pleadings made in the instant petition, it transpires that the petitioner has not challenged the order taking cognizance and despite being time granted to him though he had filed an application I.A. No. 02/2026, seeking amendment, but as there were some procedural defect in the said application, he does not want to press the application i.e. I.A. No. 02/2026 with liberty to file a fresh duly constituted amendment application and accordingly time was granted to him, but, today when the matter is called out for hearing, he further prays for time to file amendment application, which goes to show that the prayer drafted by learned counsel for the petitioners is in a very casual manner and further wasted the precious time of the Court. 6. Accordingly, the instant petition is dismissed on this ground alone with liberty to file afresh petition with appropriate prayer, subject to depositing a sum of Rs.25,000/- as cost by the petitioner before 4 the Registry of this Court and submit a receipt of the same at the time of filing of the fresh petition, if any, and the amount so deposited, if any, shall be transmitted to the Children Observation Home, Pulgaon, Durg (C.G.).
