2 Crime No.148/2026 registered at Police Station – Dongargarh, District- Rajnandgaon (C.G.), for the offences under Sections 296, 118(1) and 109 of BNS.
2.
Brief facts of the case are that on 04.03.2026 at about 1.30 p.m, Complainant Ram Kumar Verma, along with his wife, had gone to a cloth shop at Village Kolihapuri, PS Dongargarh to purchase clothes. It is alleged that the present Applicant, who was sitting beside the shop, was abusing them. After they came out of the shop, the Applicant allegedly assaulted the Complainant’s wife with a sharp- edged knife, inflicting three blows on her abdomen with the intention of causing her death. When the Complainant intervened to rescue her, the Applicant allegedly stabbed him on the abdomen and also caused an injury to his hand. Accordingly, offences as mentioned above have been registered against the present Applicant. Hence, this application.
3.
Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. He further submits that the alleged recovery of the knife is doubtful and has been falsely planted upon the Applicant. It is contended that the alleged incident took place at a public place, however, the prosecution has failed to cite
3 or examine any independent witness in support of the alleged recovery. He lastly submits that the Applicant is in custody since 22.03.2026 and the trial is likely to take considerable time for its conclusion, therefore, he may be enlarged on regular bail.
4. On the other hand, learned State Counsel opposes the bail application and submits that the injured sustained grievous injury on the abdomen and remained admitted in the ICU for 13 days, therefore, the Applicant is not entitled to be released on bail.
5. Considering the submissions advanced by learned Counsel for the parties, the nature of allegations, the material available in the case diary, the manner in which the incident is alleged to have occurred, the fact that the injured sustained grievous injury on the abdomen and remained admitted in the ICU for 13 days and without further commenting anything on the merits of the case, this Court is not inclined to grant bail to the present Applicant.
6. Accordingly, the bail application of the applicant – Hiralal Verma involved in Crime No.148/2026 registered at Police Station – Dongargarh, District- Rajnandgaon (C.G.), for the offences under Sections 296, 118(1) and 109 of BNS is hereby rejected.
