This is the first bail application under Section 483 of the SHOAIB ANWAR Digitally signed by SHOAIB ANWAR Date: 2026.07.14 17:24:24 +0530 2 Bharatiya Nagarik Suraksha Sanhita, 2023 filed by the applicant for grant of regular bail, as he has been arrested in connection with Crime No. 45/2026, registered at Police Station Sankara, District Mahasamund (C.G.) for the offence punishable under Section 20(B) of the Narcotic Durgs and Psychotrophic Substances Act, 1985 (NDPS Act). 2. The prosecution's story, in brief, is that the concerned Police Station received secret information through an informant on 03.03.2026 during patrolling that the present applicant was illegally keeping contraband ganja in his scooter for the purpose of sale. Acting upon the said information, the police intercepted the scooter and seized 4.87 kg of contraband ganja from the possession of the present applicant. Thereafter, on the basis of his memorandum statement, the police conducted a search of his house and seized a further quantity of 13.600 kg of contraband ganja. In the memorandum statement, the present applicant allegedly disclosed that the seized contraband had been procured from co-accused Piyush Sharma. As a result thereof, the police registered an offence punishable under Section 20(B) of the N.D.P.S. Act against the present applicant, and he was arrested 3 on 04.03.2026. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He submits that the contraband allegedly seized from the house of the applicant had been kept there at the instance of the main accused, Piyush Sharma. It is further submitted that only 4.87 kg of contraband ganja was seized from the exclusive possession of the applicant, whereas the remaining 13.600 kg of contraband ganja was recovered from a house situated at village Bade Kunjari, Post and P.S. Jagdalpur, Bargad (Odisha), which was not in the exclusive possession of the applicant. He further submits that the applicant has been residing in Chhattisgarh for the last 18 years. 4. Per contra, learned State counsel opposes the prayer for bail and submits that a similar criminal case, bearing Case No. 110 dated 04.08.2023, registered under Sections 274 and 275 read with Section 34 of the IPC, is pending against the present applicant at village Bade Kunjari, Post and P.S. Jagdalpur, Bargad (Odisha). It is further submitted that 4.87 kg of contraband ganja was seized from the exclusive possession of the applicant, and a further quantity of 13.600 kg of 4 contraband ganja was seized from the house in Odisha at his instance. Learned counsel for the State, by referring to the charge-sheet, submits that the entire quantity of contraband ganja was recovered from the present applicant. Considering the criminal antecedents of the applicant, it is prayed that the present bail application be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the submissions advanced by learned counsel for the parties and on perusal of the charge-sheet and the material available on record, this Court finds that 4.87 kg of contraband ganja was allegedly seized from the exclusive possession of the present applicant, and a further quantity of 13.600 kg of contraband ganja was recovered pursuant to his memorandum statement. Prima facie, the material collected during the investigation connects the applicant with the alleged offence. Further, having regard to the criminal antecedents of the applicant, this Court is not inclined to extend the benefit of bail to him at this stage. 7. Accordingly, the bail application of the applicant Teetu @ 5 Solam Das filed under Section 483 of the BNSS involved in Crime No. 45/2026 registered at Police Station Sankara, District Mahasamund (C.G.), for the offence punishable under Section 20(B) of the NDPS is rejected. 8.
