This bail application has been filed on behalf of the accused- petitioner under Section 483 of B.N.S.S. in connection with FIR No. 37/2023 registered at Police Station Vaishali Nagar, Jaipur(West) for the offence(s) under Section 406, 420, 467, 468, 471 and 120-B of IPC. 2. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. Learned counsel also submits that petitioner is in custody since long and conclusion of trial will take time. He further submits that the case is triable by Magistrate. He submits that co-accused Santosh Shankar Rao Patil has been enlarged on bail by Co-ordinate Bench of this Court vide order dated 14.07.2025 in S.B. Criminal Misc. Bail Application No.5317/2025, so no fruitful purpose would be served by keeping [2026:RJ-JP:9989] (2 of 2) [CRLMB-17115/2025] the petitioner in custody and therefore, prays that the petitioner may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor vehemently opposes the submissions made by learned counsel for the petitioner hereinabove. 4. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the petitioner that petitioner is in custody since long and co-accused Santosh Shankar Rao Patil has been enlarged on bail by Co-ordinate Bench of this Court vide order dated 14.07.2025 in S.B. Criminal Misc. Bail Application No.5317/2025. Without expressing any opinion on the merits/demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 5. Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Upendra Singh Rudradev S/o Shri Saukhilal Singh is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred on all subsequent dates of hearing and as and when called upon to do so. 6.
