The petitioners are apprehending their arrest in connection with Birni PS Case No.150 of 2026, for offence registered under section 190, 191(3), 74, 118(2), 109(1), 117(2), 304(2), 351(3) and 352 of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Giridih.

Learned counsel for petitioners submits that the petitioners have falsely been implicated in this case and there are case and counter case between the parties and altercation took place due to land dispute. He next submits that both the sides have received injury.
4. Learned State counsel as well as the learned counsel for the informant jointly oppose the prayer and submits that allegations are there of assault and pursuant to that injury has been received and in view of that, anticipatory bail may kindly be rejected.

On perusal of the FIR, it transpires that there are direct allegation against the petitioner nos.1 and 3-Manijar Saw and Ajay Kumar Saw and pursuant to that injury has been received, and in that view of the matter, I am not inclined to grant anticipatory bail to the petitioner nos.1 and 3-Manijar Saw and Ajay Kumar Saw and as such, the prayer for anticipatory bail with respect to petitioner nos.1 and 3-Manijar Saw and Ajay Kumar Saw, is, hereby, rejected.
6. In case the petitioner nos.1 and 3, above named, moves before the learned court and file appropriate petition before the learned court concerned, the same will be decided in accordance with law without prejudice to this order.

So far as the petitioner nos.2 and 4 are concerned, there are general and omnibus allegations against them and there are case and counter case and the altercation took place due to land dispute, I am inclined to grant anticipatory bail to the petitioner nos.2 and 4, namely, Vijay Saw and Birendra Kumar.

Accordingly, petitioner nos.2 and 4, namely, Vijay Saw and Birendra Kumar, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioner nos.2 and 4, namely, Vijay Saw and Birendra Kumar, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Giridih, in connection with Birni PS Case No.150 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
