Learned State counsel submits that the present petition has been preferred challenging the order passed by the Collector whereby the revision petition has merely been admitted for hearing. 2. Learned counsel for the petitioner prays for time. However, considering the nature of the impugned order, which is only an order admitting the revision petition for hearing, this Court is of the considered opinion that the petitioner ought to pursue the proceedings before the Collector, where the revision is presently pending, and raise all such pleas as may be available to him in accordance with law. 3. In view of the observations made hereinabove, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to avail the remedy available under law before the competent authority. 4. Accordingly, the petition is dismissed as withdrawn with the aforesaid liberty. It is made clear that this Court has not expressed any opinion on the merits of the case, and the Collector shall decide the pending revision independently, in accordance with law, uninfluenced by any observation made in this order.
