This Criminal Petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, “B.N.S.S.”) is filed seeking to enlarge the petitioners on anticipatory bail in Crime No.61 of 2026 of Ponnur Police Station, Guntur District, registered for the offences punishable under Sections 115(2), 118(1), 351(2) read with 3(5) of BNS and Sections 3(1 )(r), 3(1 )(s) and 3(2)(va) of the SC/ST (Prevention of Atrocities) Act. 2. Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for respondent/State. 3. Perused the record. 4. Learned Assistant Public Prosecutor submitted that the police will follow the provisions of Section 35(3) of the BNSS, 2023. 5. Since it can be seen that the offences alleged are punishable with seven years or less than seven years and considering the statement made by learned Assistant Public Prosecutor, the respondent/State is directed to comply with the mandate in Section 35(3) of the BNSS, 2023 and all the directions given by the Hon’ble Supreme Court of India in the judgment in Arnesh Kumar vs. State of Bihar1 and other related rulings.
