AKULA SRI KRISHNA SAI BHARGAV Counsel for the Respondent(S): 1. 3 The Court made the following ORDER: The 1st respondent has filed O.S.No.191 of 2021 before the Principal Junior Civil Judge, Ponnur against the petitioner and other defendants. The petitioner is arrayed as defendant No.4 in the suit. 2. The 1st respondent had filed the suit for an injunction restraining the defendants therein, including the petitioner herein from interfering with the possession of the 1st respondent over the suit schedule property. The 1st respondent had also filed I.A.No.279 of 2021 for an interim injunction restraining the respondents/ defendants therein from interfering with the possession of the 1st respondent over the said property. The trial Court, by an order, dated 17.03.2023 had granted such an interim injunction and the said interim injunction has been in force since then. 3. The petitioner, who is the 4th defendant, in the suit has now approached this Court with the contention that the suit which had been filed in the year 2021 is still pending and the existence of the interim injunction is causing great difficulties and suffering for the petitioner. In the circumstances, the petitioner seeks a direction to the trial Court for an early disposal of the suit. 4. In view of the fact that the suit has been pending for the last five years and in view of the fact that an injunction has also been operating against the petitioner for the last five years, it can only be appropriate that a direction is issued to the trial Court to complete the trial and to dispose of the suit within six (6) months from the date of receipt of this order. 4 5. Notice to the respondents, is waived inasmuch as no prejudice would be caused to the 1st respondent or other respondents if the suit is disposed of at the earliest. 6. Accordingly, this Civil Revision Petition is ordered. There shall be no order as to costs. As a sequel, pending miscellaneous applications, if any, shall stand closed. ________________________ R.
