Mr. Siva Prasad Ghose …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Division), 2nd Court at Barrackpore in Title Suit No. 222 of 2022 expeditiously. Mr. Ghose, learned advocate appearing for the petitioner submits that though a date was fixed for hearing of the application dated November 6, 2024, the said application by virtue of which the petitioner prayed for analogous hearing of this suit along with another suit, was not pressed by the petitioner. It will be open to the petitioner to bring to the notice of the learned trial judge with regard to such fact and if such an approach is made, the learned trial judge shall consider the same and pass orders accordingly. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the 2 learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing them before the learned trial judge. In the light of the submission made by the learned advocate appearing for the petitioner, CO 2079 of 2026 stands disposed of by requesting the learned Civil Judge (Jr. Division), 2nd Court at Barrackpore to make an endeavour to dispose of Title Suit No. 222 of 2022 as expeditiously as possible without granting any unnecessary adjournment to either of the parties, provided the suit is otherwise ready for hearing.
