The Court made the following ORDER:
The Civil Revision Petition is filed aggrieved by the orders passed in I.A.No.531 of 2025 in A.S.No.24 of 2025 by the learned III Additional District and Sessions Judge, Bhimavaram, (herein after referred to as ‘the First Appellate Court’ )West Godavari District. 2. The contention of the petitioner is that the petitioner is the plaintiff. They filed a suit for injunction and in that suit, the trial Court has considered and granted injunction in favour of the petitioner till disposal of the suit i.e., O.S.No.143 of 2020. Though the suit has been dismissed after trial, the petitioner has filed I.A.No.531 of 2025 for interim protection under Order 39 Rule 1 and 2 and Section 151 of C.P.C. and the same has been rejected on the ground that, the very suit itself is rejected and there are clear findings with regard to the possession. In the said circumstances, the first Appellate Court does not inclined to grant any injunction in favour of the petitioner. 3. This Court is also of the same opinion and hence, this Court is not inclined to interfere in the orders passed by the first Appellate Court in I.A.No.531 of 2025. 4. At the request of learned counsel for the petitioner and also of the
learned counsel for the respondents, this Civil Revision Petition is disposed of. However, the first Appellate Court i.e., the learned III Additional District and Sessions Judge, Bhimavaram, directing to consider the first appeal i.e.,
A.S.No.24 of 2025 and the same may be disposed of as expeditiously as possible, preferably within a period of six (06) months.
5. Accordingly, this Civil Revision Petition is disposed of. There shall be no
order as to costs. As a sequel, miscellaneous applications, pending, if any, shall stand closed.
