07.07.2026 Court No.35. D/L.270. Rakib (Rejected) CRM (M) 1122 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Pathar Pratima Police Station case no. 103 of 2025 dated 13.03.2025 under Sections 65(1)/74/351(3) of the Bharatiya Nyaya Sanhita, 2023 and Section 6(01)/08 of the POCSO Act, 2012. And In the matter of : Shaktipada Dolai @ Bhanu @ Shaktipada ……Petitioner. Ms. Swapna Roy .....for the Petitioner. Mr. Dr. Pradip Banerjee, Ld. APP Mr. Sunil Gupta ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody since 15.03.2025 and till date the case has not progressed, although, charge has already been framed. Learned advocate appearing for the State has drawn the attention of the Court to the statement of the victim under Section 183 of the BNSS as well as the medical documents. It has also emphasized that on last few occasions the accused sought for time, as such, the evidence could not proceed. I have taken into account the materials appearing in the Case Diary, particularly, the accusations against the present petitioner. Having considered the same, I am not inclined to release the petitioner on bail at this stage without the evidence of the victim is over. Accordingly, CRM (M) 1122 of 2026 is dismissed. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
