Order on Board 14.07.2026
1. The petitioner has filed this petition seeking following relief (s) :
“10.1 That, this Hon'ble Court, may kindly call for the entire record in relates to the case of the petitioner. 10.2 That, this Hon'ble Court, may kindly be
-2- pleased to issued a writ / or writs / order / or orders / to direct the respondents authorities, to allow the petitioner for interview on the post of Assistant Geologist looking to the facts and circumstance of the case, in the ends of justice. 10.3 That, any other relief, this Hon'ble Court, deem fit and proper may also kindly be granted to the petitioner, in the interest of justice.”
2. Learned counsel appearing for the petitioner would submit that on 02.02.2022, an advertisement was issued by the Chhatisgarh Public Service Commission for filling up the posts of Mining Officer, Assistant Geologist and Mining Inspector. He would further submit that the petitioner had submitted his application form for the post of Assistant Geologist; an admit card was issued and he participated in the written examination.
He would contend that the petitioner had cleared the written examination and was invited for an interview scheduled on 23.08.2022 but during course of document verification, it was found that the petitioner failed to submit income certificate as he belongs to the Other Backward Class (Non- creamy layer) and on that ground, his candidature has not been considered. He would submit that a direction may be issued to the respondent authorities to permit the petitioner to participate in the interview. 3. On the other hand, learned Advocates appearing for the respondents would oppose the submissions. They would submit that the selection process was completed in the year 2022 itself. They would contend that the select list was published on 24.08.2022 and thereafter, the selected candidates were offered
3 appointment. They would contend that as the petitioner has sought relief to participate in the interview, this petition has become infructuous after conclusion of the recruitment process. 4. Heard the learned counsel appearing for the parties and perused the documents placed on record. 5. Admittedly, the petitioner participated in the recruitment process for the post of Assistant Geologist. He cleared the examination and was called for the interview but during course of document verification, his candidature was not considered and an objection was raised on the ground that he failed to submit income certificate, as he belongs to the Other Backward Category. Subsequently, the Selection Committee completed the selection process and published the select list on 24.08.2022 and thereafter, appointment orders were issued in favour of the selected candidates. 6. Having considered the facts discussed above and the relief sought for by the petitioner, no such direction, as prayed for, can be granted. Accordingly, this petition fails and is hereby dismissed. sd/-
