Learned advocate appearing for the petitioner submits that the subject matter of the case relate to recovery of 699 bottles of phensedyl. Petitioner happens to be similarly placed as other accused persons who have been granted bail in CRM (NDPS) 898 of
2026. Learned advocate appearing for the state opposes the prayer for bail but is unable to refute the contention that the petitioner not being similarly placed as the other accused persons who have been granted bail. In view of the aforesaid observations, I direct the petitioner namely, Mobarak Sekh to be released on bail on same terms and conditions as was imposed upon the other accused persons namely, Afsar Ali and Nasirul Sk in CRM (NDPS) 898 of 2026. Thus, CRM (NDPS) 1398 of 2026 is allowed.
2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
