KUNCHANGI VILLAGE, ANAKAPALLI MANDAL, ANAKAPALLI DISTRICT. 531001 ...RESPONDENT(S): Counsel for the Petitioner(S): P NANILU NAIDU Counsel for the Respondent(S): GP FOR REVENUE The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the respondents nos. 2 to 4 in demolishing and trying to dispossess the plots of the petitioners in plot no 28, 20, 13, 32 and 34 admeasuring each 0. 01 1/2 cents amounting to a total of 7 1/2 cents situated in Survey no. 379P Kunchangi village Anakapalli Mandal Anakapalli District without issuing any notice without affording any opportunity to the petitioners without informing the petitioners as illegal arbitrary and against the principles of Natural Justice besides violation of Article 14 21 and 300A of Constitution of India and to consequently direct the direct the 2 to 4 respondents not to demolish and not to dispossess the petitioners from their respective plots in plot no 28, 20, 13, 32 and 34 admeasuring each 0. 01 1/2 cents amounting to a total of 7 1/2 cents situated in Survey no 379P Kunchangi village Anakapalli Mandal Anakapalli District In the interest of justice Prayer amended as per courts Order Dt 14. 05. 2026 in I A No 2 of 2026 and pass….” 3 Dr. YLR, J W.P.No.7882 of 2026 Dated 21.05.2026 2. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader. 3. Mr. P. Nanilu Naidu, learned counsel for the petitioners, submits that respondent Nos. 2 to 4 are trying to demolish the structures on the plots and dispossess the petitioners from the plots without following the due process of law. 4. Mr.T. Sanjeev Rao, learned Assistant Government Pleader for Revenue, on written instructions, submits that possession certificates were mistakenly issued with regard to Plot Nos. 28, 20, 13, 32 and 34, admeasuring Ac.0.01½ cents each, amounting to a total extent of Ac.0.07½ cents situated in Survey No.379P of Kunchangi Village, Anakapalli Mandal, Anakapalli District, without issuing notice and providing an opportunity. 5. It is further submitted that, if the petitioners are eligible for house site pattas, their cases would be considered by the Revenue Divisional Officer with the permission of the Assignment Committee and thereafter house site pattas would be issued to the eligible beneficiaries. It is further submitted that the connected documents and records could not be traced in the office of the Tahsildar, Anakapalli. The LPCs issued to the petitioners are required to be cancelled and, after obtaining due permission from the Assignment Committee, another layout has to be prepared and house site pattas, instead of LPCs, would be distributed to the eligible beneficiaries in the village. 4 Dr. YLR, J W.P.No.7882 of 2026 Dated 21.05.2026 6. The learned counsel for the petitioners submits that, pursuant to the grant of house site pattas, the petitioners have made certain constructions and have been in possession and enjoyment thereof, and that respondent No. 4 all of a sudden came with a bulldozer and attempted to demolish the constructions. 7. The learned counsel for the petitioners further submits that, except Plot No.28, no constructions have been carried out in the remaining plots. The submissions of the petitioners are recorded. The petitioners, in whose plots no constructions have been made as of now, shall not undertake any construction activity until appropriate orders are passed by respondent No. 4 with regard to the grant of house site pattas. 8. Be that as it may, respondent No.4 has to follow due process of law before undertaking demolition of the ongoing constructions being carried out by the petitioners. Respondent No.4 shall not demolish the ongoing constructions and evict the petitioners from the disputed plots without following due process of law. 9. Considering the entire facts and circumstances of the case, the Writ Petition is disposed of directing the respondent No.4 not to demolish the structures already made on the plots and not to dispossess the petitioners from the plots without following due process of law. 10. In the result, the Writ Petition is disposed of.
