2 THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION No.12821 OF 2014 ORDER :
1. The petitioner seeks a direction to the respondents to release the salary due and payable to him after his reinstatement, in pursuance of the orders passed by this Court in W.P. No.10154 of 2011. The petitioner was initially engaged as a Field Assistant in April, 2006. In the year 2009, allegations were made that the petitioner had disbursed amounts to a Mastry engaged for the construction of a wall and that a sum of Rs.1,624/- was credited to the petitioner’s account.
In this regard, an explanation was called for and an enquiry was conducted, pursuant to which the respondents terminated the services of the petitioner vide proceedings dated 31.07.2009. Challenging the said proceedings, the petitioner filed W.P. No.10154 of 2011, and this Court, by order dated 29.04.2011, set aside the order of termination and directed the respondents to verify the records and pass appropriate orders. 2. It is submitted that the petitioner was reinstated as Field Assistant on 27.08.2011; however, no salary was paid to him. In this regard, the petitioner submitted representations, which have not been considered. 3. The learned Standing Counsel appearing for respondent No.3 submits, on written instructions, that the petitioner did not show any interest in working in the field and did not generate any man-days, i.e., provide work to wage seekers in the G.P. As a result, his salary could not be drawn. It is also stated that the petitioner is not entitled to any payment for the period
3 during which he did not render any service, on the principle of “no work, no pay.”
4. Considering the fact that the petitioner has not produced any material to demonstrate that he discharged his duties as a Field Assistant after his reinstatement, this Court is not inclined to pass any order directing release of the claimed amounts. 5. Accordingly, the writ petition is closed. No costs. As a sequel, miscellaneous applications, pending, if any, shall stand closed. ____________________ JUSTICE HARINATH.N Dated 16.03.2026 KGM
