Learned advocate appearing for the petitioner submits that petitioner is innocent of the charges being a businessman carrying on business of tobacco leaves. There are hardly any materials to connect the petitioner because of the search and seizures being carried out at the behest of the investigating agency wherein certain bags were recovered out of the supplies which were being made. There was a continuous transaction so far as the tobacco leaves are concerned between the present petitioner and the husband of Selima Bibi. There is no possibility of the trial being concluded in near future and the petitioner is in custody for about 17 months. Learned advocate appearing for the State on the other hand opposes the prayer for bail and relies upon the Case Diary to emphasise on the issue of relationship between the present petitioner and Nur Islam Miah, the other accused. It has been 2 submitted that the seizure in this case is 467.18 kgs of ganja/contraband. There are monetary transactions which would reflect the relationship. Already, in respect of another accused in CRM (NDPS) 807 of 2026 there has been a direction to conclude the trial within a year from date of communication of the said order. Having regard to the overall circumstances, quantum of seizure and the attending materials, at present, I am not inclined to release the petitioner on bail. Thus, application for bail of the petitioner in CRM (NDPS) 1337 of 2025 is dismissed. Petitioner would be at liberty to approach this Court at the appropriate stage. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
