Therefore, they are before this Court. - 3 - HC-KAR NC: 2026:KHC:34095 CRL.P No. 7294 of 2026 4. The material available on record would go to show that based on credible information received, on 31.03.2026 at about 05.15 p.m., first informant along with his staff had raided the alleged place where accused persons were trying to sell contraband article to the public and had apprehended accused Nos.1 and 2 and from their possession, contraband article allegedly methamphetamine totally weighing 2.2 grams was seized. Subsequently, apprehended accused were arrested and remanded to judicial custody. It is not in dispute that accused Nos.1 and 2 do not have any other criminal antecedents. Investigation of the case is now completed and charge sheet has been filed. Upto 2 grams of methamphetamine is considered as small quantity and between 2 grams and upto 50 grams of methamphetamine is considered as intermediate quantity. In the present case, seized contraband article allegedly methamphetamine totally weighed about 2.2 grams, which is a little more than the small quantity and the same has to be considered as intermediate quantity. Therefore, the rigour under Section 37(1)(b) of the NDPS Act, 1985, cannot be made applicable to the case on hand. Under the circumstances, I am - 4 - HC-KAR NC: 2026:KHC:34095 CRL.P No. 7294 of 2026 of the opinion that the prayer made by the petitioners, who have no other criminal antecedents, for grant of regular bail needs to be answered affirmatively.
