07.07.2026 Item No.54, DL Court No.18 AJ. IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION
W.P.A. 1616 of 2026
Trishna Ghosh
-Vs- The State of West Bengal & Ors. Mr. Pratip Kumar Chatterjee, Ms. Maitrayee Chatterjee. ….for the petitioner. Mr. Amrita Lal Dhar, Mr. Rhitam Chatterjee. …for the State. Ms. Tapasi Sinha Palit ….for the respondent no.3. Mr. Abhishek Banerjee, Ms. Parna Roy Choudhury, Ms. Trisa Chanda. ….for the Punjab National Bank. 1. The petitioner’s grievance is that the pension payable to her on account of her Late husband, a former employee of the bank has been reduced without any reason. 2. A report was called for from the concerned authorities by this Hon’ble Court by an order dated 25th February, 2026. A report has been filed on March, 2026. The report is kept on record. The report very casually seeks to mention that the pensionary benefits of the Late Sambhu Nath Ghosh, the petitioner’s husband was to start at a reduced rate from January 31, 2017, but continued at the enhanced rate till 30th June, 2025. Hence, from
2 July, 2025, the authorities have sought to appropriate the enhanced amount, on account whereof the pensionary benefits have been paid at a reduced rate to the petitioner. The report is bare and very casual. There are no calculations as to why the petitioner’s husband would get pension at a reduced rate from January, 2017, nor does it give any calculation of such reduced amount. 3. In fact, the petitioner’s representation through her Advocate stated sometime on June 2026 has been kept pending without any deliberation. 4. It is now an expected proposition that if payments have been made without the fault of the incumbent, the same should not be realized in any manner. The Supreme Court in the decision of Shyam Babu Verma –Vs- The Union of India reported in AIR Online 1994 SC 411 as well as in the State of Punjab –Vs- Rafiq Masih reported in 2015 4 SCC 334 have in no uncertain terms reiterated the aforestated proposition. 5. I direct the Treasury Officer (Pension), the respondent no.2 herein to consider the representations/demand justice made sometime in December, 2025 by the petitioner by August
3 31, 2026 in lying with the decisions of the Hon’ble Supreme Court of India as aforestated upon giving a hearing to the petitioner or her duly authorized representative.
The resultant reasoned order will be communicated to the petitioner within a period of ten days from August 31, 2026. 6. With the aforestated direction, WPA 1616 of 2026 stands disposed of. There shall be no order as to costs. 7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
