Kausik (Allowed) CRM (NDPS) 1388 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nabagram Police Station Case No. 429 of 2023 dated 4th of December, 2023 under section 21(C)/29 of the NDPS Act, 1985. And In the matter of : Ananta Mandal ……Petitioner. Mr. Arnab Chatterjee Mr. Avik Ghosh Ms. Ankusha Ghosh ……for the Petitioner. Ms. Arushi Rathore ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 3 months and 5 witnesses out of the cited 14 witnesses have been examined till date. So far as the driver of the vehicle is concerned, he has been granted statutory bail and the petitioner happens to be the owner of the vehicle, which, according to the prosecution, was used for carrying 1300 bottles of phensedyl. Learned advocate for the State opposes the prayer for bail and submits that petitioner was evading the process of law for a considerable period of time. Records of the case reflect that the case was registered in the year 2023. Petitioner was arrested on 7th April, 2025. 2 5 witnesses have been examined till date. Some time will be required to conclude the prosecution. Having taken into account the overall circumstances, I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Ananta Mandal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge (under NDPS Act), 2nd Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Special Court. Additionally, petitioner shall, for a period of 1 year from the date of his release, meet with the Officer-in-Charge, of Nabagram Police Station once in a fortnight and obtain an acknowledgment. Such acknowledgment be submitted before the learned Trial Court. It would be discretion of the learned Trial Court either to waive such condition after the said period or continue with such condition imposed. Accordingly, CRM (NDPS) 1388 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
