JUSTICE P SREE SUDHA ORAL ORDER Learned counsel for the petitioner is present and it is submitted that he has served copies to learned counsel for respondent appearing before the trial Court on 16.04.2026 and also filed a memo to that effect. 2. There is no representation on behalf of respondent. 3. Heard the arguments of learned counsel for the petitioner. 4. This civil petition is filed by the petitioner/wife seeking transfer of M.C.No.7058/2025, filed by husband for - 3 - HC-KAR NC: 2026:KHC:33090 CP No. 113 of 2026 divorce before the Principal Judge, Family Court, Bengaluru. The petitioner-wife is residing with her parents at Shivamogga and she is not working and earning. The distance between Bengaluru and Shivamogga is 305 kms. It is stated that respondent-husband is employed as a Senior Software Engineer with Genesys Cloud Services Ireland Ltd., Ireland and he is not residing in the country. The petitioner - wife has also filed M.C.No.389/2025 for restitution of conjugal rights, which is pending before the Principal Judge, Family Court, Shivamogga and also filed C.Misc.No.244/2025 for maintenance, before the Principal Judge, Family Court, Shivamogga. She has stated that due to financial constraints she is unable to attend the proceedings at Bengaluru and her parents are suffering age old ailments and there is no one to accompany her to Bengaluru. 5. Considering the arguments of learned counsel for the petitioner in the absence of respondent's arguments and also the fact that other matters are pending before the Family Court, Shivamogga and respondent is residing in Ireland, this court finds it just and reasonable to transfer M.C.No.7058/2025 filed by husband for divorce from V Additional Principal Judge, Family Court, Bengaluru to Family Court, Shivamogga. to try - 4 - HC-KAR NC: 2026:KHC:33090 CP No. 113 of 2026 along with M.C.No.389/2025 filed by the petitioner/wife for restitution of conjugal rights. The Family Court is specifically directed to club both the proceedings and to dispose of them together, in order to avoid conflicting judgments. Accordingly, the civil petition is allowed.
