1. The petitioners have no cause of action to come to this Court on the strength of a Succession Certificate issued by the Principal District Judge, Budgam on File No. 25/S.
2. This Court is making this observation for the reason that the petitioners, who are the co-holders of the succession certificate, have not come forward disclosing as to how and when they had come to approach the respondent No. 3- Executive Engineer, Public Works (R&B) Department, Division Beerwah, District Budgam with the succession certificate claiming release of the amount as per the share apportioned by the Principal District Judge, Budgam because if the petitioners would have so approached the respondent No. 3- Executive Engineer, Public Works (R&B) Department, Division Beerwah, District Budgam with any such application in writing, then this Court would have 143 Suppl- I
accommodated the petitioners with their cause of action by reference to the delay on the part of the Executive Engineer, Public Works (R&B) Department, Division Beerwah, District Budgam, in doing the needful and carrying out the release of the money, in case the same is lying within his immediate control and authority.
3. As there is nothing accompanying the writ petition in the name of said application from the end of the petitioners if made to the respondent No. 3 except a bald plea that the petitioners have repeatedly approached the respondents, including even the Commissioner Secretary to Government, PWD Department, the Chief Engineer PWD, Srinagar and also the Executive Engineer, PWD, Division Beerwah, District Budgam, this Court cannot extend its indulgence in the matter.
4. Let the petitioners approach the Executive Engineer, PWD, Division Beerwah, District Budgam with a proper application along with a certified copy of the succession certificate and ask for release of the proportionate share of the money, in case the security amount is lying with the Executive Engineer concerned. 5.Accordingly, the writ petition stands dismissed.
