The petitioner has been rested from service on the ground that he had been involved in the illegal appointment of certain persons as Assistant Teachers in several schools. This issue was being investigated by the Criminal Investigation Department (CID), pursuant to the directions of this Hon’ble Court. Though the petitioner had been arrested, he is presently enlarged on bail. 3. The petitioner was suspended on March 31, 2023. However, the petitioner cannot be kept suspended for all times to come without there being initiation of any disciplinary proceeding or consequences thereof. 4. I direct the respondent no. 4 viz. Commissioner of School Education, West Bengal to consider the representations of the petitioner dated July 17, 2023 and December 12, 2023 respectively in accordance with law and in light of the decision of the Hon’ble Supreme Court of India in Ajay Kumar Choudhary vs. Union of India Through its Secretary & Anr. reported in (2015) 7 SCC 291. The entire exercise should be concluded by August 15, 2026. The resultant order be 2 communicated to the petitioner by August 20, 2026 and consequential steps be taken depending on the order that may be passed. 5. With the afore-stated directions, WPA 15385 of 2026 is disposed of. 6. There shall be no order as to costs. 7.
