Kausik (Allowed) CRM (NDPS) 1385 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Dankuni Police Station Case No. 47/2026 dated 04.02.2026 under Section 20(b)(ii)(c)/25 of the NDPS Act, 1985. And In the matter of : Sk. Haider Ali @ Babu ……Petitioner. Mr. Prosenjit Ghosh Mr. Sagnik Bhattacharya Ms. Shreyata Mitra ……for the Petitioner. Mr. Shataroop Purkayastha ……for the State. Records of the case reflect that the subject matter of the present case relate to alleged recovery of 25.270 Kgs. of Ganja. Charge sheet has already been submitted before the jurisdictional Court. Petitioner is in custody for about 5 months. Having considered the totality of the circumstances and the prosecution has relied upon 10 witnesses to prove its case, I am of the view that the petitioner be released on bail. Accordingly, Petitioner, namely, Sk. Haider Ali @ Babu shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand 2 Only) each, one of whom must be local to the satisfaction of Learned Judge (under NDPS Act), Hooghly. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Hooghly without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1385 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
