IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 224 CRM-M-34655-2026 (O&M) Date of Decision: 07.07.2026 MONU ....Petitioner V/s STATE OF HARYANA .…Respondent CORAM: HON'BLE MR. JUSTICE VIKRAM AGGARWAL Present: Mr. Arpil Sharma, Advocate for the petitioner. Ms. Vasundhara Dalal Anand, Sr. DAG, Haryana. *** VIKRAM AGGARWAL, J. (ORAL) Prayer in the present petition preferred under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short the ‘BNSS’) is for the grant of regular bail to the petitioner in case FIR No.521 dated 17.12.2025 registered under Sections 118(1), 126(2), 190, 191(3), 351(2), 109(1), 115(2) of BNS and Sections 25 of Arms Act at Police Station Sector 8, District Faridabad (Haryana). 2. Custody certificate dated 06.07.2026 filed by learned State counsel in Court is taken on record. 3. On the statement of one Badal, the FIR in question was registered. It was alleged that on 17.12.2025 at about 01:30 PM, he received a phone call from Monu (petitioner), who asked him to come to the parking of Vita Dairy. When he, along with his friends Priyanshu, Mehar, Karan and Dev reached the parking lot of Vita Dairy, Monu, Rishabh and 8-10 other boys present there started beating him and his friends with fist and kick blows. One of them took out a knife and stabbed him and his friend Daksh and Monu and the other boys threw stones upon him. When he and his MANI KUMAR 2026.07.07 19:55 I attest to the accuracy and integrity of this document CRM-M-34655-2026 (O&M) -2- friends tried to escape from the spot, they were stopped and again given kick and fist blows. The assailants fled after a crowd gathered at the spot. 4. Learned counsel for the petitioner submits that the petitioner is in custody since 18.12.2025; final report stands submitted but charges have not yet been framed; no recovery has been made from him; no injury has been specifically attributed to the petitioner; co-accused Pranjal, Lokesh, Rishabh Raj and Harish have been granted regular bail by the Court of Additional Sessions Judge, Faridabad; trial will take a sufficiently long time and therefore, no useful purpose would be served by keeping the petitioner in custody any longer. 5. Per contra, learned State counsel has opposed the bail application, stating that the complainant is yet to be examined and that if the petitioner is released on bail, he may tried to influence and threaten the witnesses. 6. I have considered the submissions made by learned counsel for the parties. 7. Concededly the main accused who is alleged to have given a knife blow to the complainant is a juvenile. The other co-accused have already been released on regular bail. The allegation on the petitioner is of throwing stones. As to whether he had actually committed the offence or not, shall be determined at the stage of trial. The petitioner is a young boy of 21 years and is in custody since 18.12.2025; no recovery has to be made from him; final report already stands submitted and no witness has been examined till date. Co-accused Pranjal, Lokesh, Rishabh Raj and Harish already stand released on bail by the Court of Additional Sessions Judge itself, therefore, in the considered opinion of this Court, no useful purpose would be served by keeping the petitioner in custody any longer. MANI KUMAR 2026.07.07 19:55 I attest to the accuracy and integrity of this document CRM-M-34655-2026 (O&M) -3- 8. In view of the aforementioned facts and circumstances, without expressing any opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Chief Judicial Magistrate/Duty Magistrate. 9. Pending application(s), if any, shall also stand disposed of.
