1. Matter is heard in presence of the learned advocates representing the petitioner and State respondents.
2. Petitioner is aggrieved by in-action on the part of the concerned police authority in not taking steps based on the complaint dated 8th April, 2026 lodged by the petitioner.
3. Petitioner prays for direction upon the concerned police authority to take steps accordingly.
4. On perusal of the complaint dated 8th April, 2026 made by the petitioner, it appears that a partition suit is pending being no.151 of 2016. During pendency of the partition suit petitioner was threatened. It is also stated that elder brother of the petitioner filed aforesaid partition suit and after his death heirs of elder brother were substituted in the said suit.
5. If petitioner is threatened and concerned police authorities are not taking necessary steps, in that event, petitioner is required to approach jurisdictional Magistrate under Section 175 (3) of BNSS, 2023.
6. Petitioner shall also be at liberty to approach Civil Court if civil right of the petitioner is infringed.
7. Writ petition stands disposed of.
