02 /18.09.2026: This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 302, 34 of the Indian Penal Code.
2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.
3. This is the second attempt by the petitioner for grant of bail. His prayer for bail was earlier rejected on merits on 25.03.2026 in B.A. No. 7221 of 2025.
4. It has been submitted that other accused persons have been acquitted but in a different trial, since this petitioner was absconding.

Learned counsel for the State opposes the prayer for bail and submits that the petitioner remained absconded since the year 2018 till 12.01.2025. There is specific allegation against the petitioner that he along with others came to the informant’s house and forcibly took her husband and soon after that her husband found dead.
6. Considering the fact that the petitioner was an absconder and there is specific aforesaid allegation against the petitioner, I

am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with S.T. Case No. 261B of 2019 arising out of Tarhasi P.S. Case No. 30 of 2018 corresponding to G.R. Case No. 925 of 2018, pending in the Court of learned Additional Sessions Judge-II, Palamau at Daltonganj stands rejected.
7. Accordingly, this bail application is dismissed.
8. The Trial Court should try to conclude the trial within four months since only four witnesses are remained to be examined in this case. The prosecution should produce the witnesses on regular interval.
