07.07.2026 Sl. No. 12 Ct No. 5 SG WPA 14203 of 2026 Angura Bibi Seikh Vs The State of West Bengal & Ors. Mr. Dhananjay Banerjee, Mr. Pralay Hazra, Mr. Partha Sarathi Mishra. …for the petitioner Mr. Suryaneel Das, Ms. Anita Kundu, Ms. Sumita Sarkar. …for the State Mr. Pradyat Saha, Mrs. Shreyosi Chakraborty. …for respondent nos. 4 & 8 1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. Learned advocate representing the petitioner submits that concerned police authorities are not taking steps based on the order passed by the Civil Court being Order No. 12 dated 30.06.2025 passed on an application under Section 151 of Code of Civil Procedure. According to the petitioner police authorities ought to have taken steps for compliance of the order dated 27.06.2024. 3. Learned advocates representing the State respondents and respondent nos. 4 and 8 have jointly opposed this writ petition and it is submitted that the issue needs to be decided by the Civil Court. 4. On hearing the learned advocates representing the parties and taking note of the order dated 30.06.2025 2 passed by the Civil Court on an application under Section 151 of CPC, it appears that Civil Court directed the police authorities to take necessary measures for compliance of the ad interim order dated 27.06.2024. However, the said ad interim order dated 27.06.2024 is not enclosed to this writ petition. Subsequent order passed by Civil Court being Order No. 11 dated 30.06.2025 is annexed wherefrom it appears that Civil Court restrained the defendants from changing nature and character of the suit property. However, in the Order No. 12 dated 30.06.2025 which was passed on the same date when Order No. 11 was passed by the Civil Court, it was not elaborated in what respect ad interim order dated 27.06.2024 was violated by the defendants. 5. Therefore, this Court is not inclined to interfere with this writ petition thereby giving direction upon the concerned police authorities to implement the ad interim order dated 27.06.2024 and the writ petition stands dismissed. 6. However, this order shall not preclude the petitioner to approach the Civil Court in pursuit of remedy. 7. Parties to act on the server copy of this order duly downloaded from the official website of this Court. (Saugata Bhattacharyya, J.)
