JUSTICE ALOK KUMAR ORAL ORDER 3 23-07-2026 Heard learned counsel for the petitioner and learned APP for the State. Perused the Case Diary. 2. The petitioner seeks bail in connection with Tetarhat P.S. case No. 21 of 2025, instituted for the offences under Section 103 of the Bharatiya Nyaya Sanhita, 2023. 3. Prosecution case, in short, is that the daughter of the informant was married to one Kundan Manjhi and out of said wedlock, two children were born. Later on, they were separated and daughter of the informant married with the petitioner. It is further alleged that petitioner strangulated the daughter of the informant and fled away. 4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.07.2025 and has three criminal antecedents. Patna High Court CR. MISC. No.38066 of 2026(3) dt.23-07-2026 2/2 5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 6. Having heard the parties and perused the case diary. From perusal of Post-mortem report, it appears that there is ligature mark present over mid of neck, ligature mark colour reddish brown over the neck and cause of death is due to cardio respiratory failure due to asphyxia. The finding of the Doctor indicates to the fact that victim was strangulated. Considering the aforesaid facts and circumstances of the case and nature and gravity of the offence, this Court is not inclined to grant bail to the petitioner. 7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected. manish/- (Alok Kumar, J) U T
