GP FOR HOME 3 THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI WRIT PETITION NO: 14907/2026 ORDER: This writ petition is filed under Article 226 of the Constitution of India by the petitioners seeking the following relief: “…to issue a Writ, Order, or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 5th Respondent in repeatedly summoning the Petitioners to the police station and illegally interfering in purely civil disputes between family members by coercing the Petitioners to part with their property and withdraw pending civil and criminal proceedings, as illegal, arbitrary, without authority of law, and violative of Articles 19, 21 and 300-A of the Constitution of India, and consequently directing the Respondents not to interfere with the Petitioners personal liberty and peaceful enjoyment of their property except in accordance with law…” 2. Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioners submitted that the respondent-police are repeatedly summoning the petitioners to the police station and interfering in civil disputes between the petitioners and their family members. 4. Learned Assistant Government Pleader for Home submitted the written instructions received from the Sub-Inspector of Police, Duggirala P.S., Guntur District and the relevant portion of the written instructions is extracted hereunder: “It is respectfully submitted that the Smt. Kunala Baby Kaladhari, W/o. Kunala Venkata Purna Nageswararao, aged about 46 years, R/o. D.No.5-57, Emani Village, Duggirala Mandal, Guntur District in the village of Emeni, we received an emergency call 4 (112) saying that Kunala Geeta Madhuri, W/o. Kunala Shanmukha Prasad and her family members were quarreling and causing trouble at their home. Therefore, our staff attended the emergency call and investigated. We informed that as the matter is related to ancestral property, families should discuss this issue in the presence of their elders either in Hon'ble Court. It is further respectfully submit that all the allegations leveled by the petitioners are baseless and untruth and as such the petitioner denied the allegations. For the reasons stated above, it is, therefore, prayed that this Hon'ble High Court may be pleased to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice.” 5. Recording the same, the Writ Petition is disposed of. However, the respondent-police are directed not to interfere in the civil disputes without following the due process of law. There shall be no order as to costs.
