The petitioner has been in receipt of notice dated 21.07.2025 issued by respondent No.5. The said notice reads as under:

2. Aggrieved by the same, the present writ petition is filed with the following prayers:
"a) A writ in the nature of certiorari quashing the notice dated 21.07.2025 bearing No.Ra.Ni(Cha./PTCL/PR/124/ 2025-26 vide Annexure-'D' issued by the 5th Respondent and all further or consequential action in any manner whatsoever;
b) Grant Costs;

c) Such other reliefs as this Hon'ble Court deems fit to grant under the facts and circumstances of the case and in the interest of justice and equity."
3. The case of the petitioner is that, respondent No.5 does not have any authority to issue such a notice. 4. It is further submitted that petitioner is the owner of the property which is the subject matter of the writ petition and he is not aware of any PTCL proceedings as alleged in the said notice, much less an order of eviction against the petitioner. 5. Per contra, learned counsel for the respondents submit that, land concerned is a granted land and an order has been passed in favour of the grantee. However, learned AGA as well as learned counsel for respondent No.6 fairly submits that, respondent No.5 does not have jurisdiction to issue the aforementioned notice.
Further learned counsel for respondent No.6 submits that, he may be granted liberty to proceed against the petitioner or any other person like who is making a claim against the land concerned in accordance with law. - 5 -

6. At this juncture, learned counsel for the petitioner also submits that, he may be given liberty to initiate appropriate proceedings to defend his interest in respect of the land concerned. 7. Admittedly, both the petitioner as well as respondent No.6 are making a claim in respect of the lands which is the subject matter of the writ petition. However, both the petitioner as well as learned AGA and learned counsel for respondent No.6 fairly submit that respondent No.5 does not have the necessary authority to issue the notice. Further, both petitioner and respondent No.6 in the course of the proceedings prayed for liberty to initiate appropriate proceedings to protect the rights in respect of the property may be reserved. 8. As it is admitted that respondent No.5 does not have necessary authority to issue the impugned notice, the same is liable to set aside. It is needless to state that the petitioner and respondent No.6 are at liberty to initiate appropriate proceedings to protect the rights in respect of the property which is the subject matter of the writ petition, if they have any. - 6 -

9. Hence, the following:
ORDER
(i) The impugned notice issued by respondent No.5 dated 21.07.2025 vide Annexure-D to the writ petition is hereby set aside; (ii) Liberty is granted to the petitioner as well as respondent No.6 to initiate/continue proceedings to protect the rights, if they have any right in respect of the land which is the subject matter of the writ petition, before the appropriate authority concerned; (iii) Accordingly, writ petition is disposed of.
