Case No. 2326 of 2022). And In Re : Asia Bibi @ Ashia Bibi @ Ayesha Bibi and another ... Petitioners. Mr. Mrityunjoy Chatterjee, Ms. Suchismita Chakraborty ... For the Petitioners. Learned advocate appearing for the petitioners submits that the petitioner no.1 is in custody for more than 3 years and petitioner no.2 is in custody for more than 2 years. Till date, only 4 witnesses have been examined, out of 17 witnesses cited by the prosecution and the prosecution would consume much more time to take the trial to its logical conclusion. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the statement of the eyewitnesses. I have taken into account the complicity of the present petitioners. So far as the statement of witnesses is concerned, there is complicity of the present petitioners; their involvement ex facie is appearing from the statement of the witnesses. However, considering the period of detention 2 of the present petitioners and there are no criminal antecedents as the present petitioners are ladies, without entering into the merits of the case, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed. Accordingly, the petitioners viz., 1. Asia Bibi @ Ashia Bibi @ Ayesha Bibi and 2. Alpana Bibi shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Lalbagh, Murshidabad. If on bail, the petitioners shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Trial Court. Additionally, the learned Trial Court, for the ends of justice, is empowered to impose such condition as it deems fit and proper for the progress of the trial. The application for bail, being CRM (M) 1150 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
