Kausik (Rejected) CRM (M) 943 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Tamma Police Station Case No. 93 of 2024 dated 30.07.2024 under section 6 of POCSO Act, 2012 read with Section 329(4)/127(2) of the BNS, 2023 added section 74/351(3) of the BNS, 2023. And In the matter of : Soumyajit Chandra ……Petitioner. Ms. Triparna Roy ….for the Petitioner. Ms. Arushi Rathore Mr. Amartya Mohan Bhattacharyya …for the State. Learned advocate appearing for the petitioner submits that the evidence of the victim do not support the prosecution case and the petitioner being in custody for about 2 years may be released on bail. Petitioner has also handed over a copy of the evidence of the victim. Learned advocate for the State opposes the prayer for bail. Victim is present in-person. I have taken into account the materials appearing in the deposition of the victim and her consistent stand and is of 2 the opinion that this is not a fit case for releasing the petitioner on bail. However, the petitioner is in custody for about 2 years as apprised to this Court. Only 4 witnesses till date has been examined. 13 more witnesses are yet to be examined. Learned Trial Court would within a period of 6 months complete all the relevant witnesses. Petitioner would renew his prayer for bail after the aforesaid time period is over. At this stage, CRM (M) 943 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
