07.07.2026 Sl. No. 18 Ct No. 5 SG WPA 14353 of 2026 Tamal Sovan Chandra Vs The State of West Bengal & Ors. Mr. Tirupati Mukherjee. …for the petitioner Mr. Ranojoy Chatterjee, Mr. Swarnajit Das. …for the respondent nos. 6 & 8 Mr. Suryaneel Das, Mr. Partha Chakraborty. …for the State 1. At the time of call accommodation is prayed for on behalf of the petitioner. However, State respondent and respondent nos. 6 and 8 are represented by learned advocates. 2. Learned advocates representing the State respondents and respondent nos. 6 and 8 have jointly submitted that petitioner has made a prayer for registering FIR based on the complaint lodged. It is also submitted that there is an alternative remedy available to the petitioner under Section 175(3) of BNSS, 2023. 3. In consideration of the case made out in this writ petition this Court finds that petitioner has an alternative remedy to approach the jurisdictional magistrate under Section 175(3) of BNSS, 2023 in the event petitioner’s complaint is not transformed into an FIR. In this regard reliance in placed on the judgment of the Hon’ble 2 Supreme Court reported in (2007) 6 SCC 171, Aleque Padamsee And Ors vs Union Of India. 4. Hence, the present writ petition is not entertained and the same stands dismissed. 5. However, this order shall not preclude the petitioner to approach the jurisdictional magistrate in pursuit of remedy. 6.
