Kausik (Rejected) CRM (M) 1115 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Serampore PS Case No. 314 of 2025 dated 28.05.2025 under Sections 126(2)/118(2)/109 of the BNS. And In the matter of : Md. Maqsood Alam @ Chhangu @ Maqsood Alam ……Petitioner. None appears on behalf of the State in spite of the case being a sessions triable offence. Only one witness till date has been examined. Learned advocate for the petitioner submits that the case is under Section 109 of the BNS. At this stage, I am not inclined to release the petitioner on bail having regard to the observations earlier made in CRM(M) 2683 of 2025. Learned Trial Court is directed to prepone the evidence of the injured. Petitioner will renew his prayer for bail after the evidence of the injured witness is over. At this stage, CRM (M) 1115 of 2026 is dismissed. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
