Roy …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division), Durgapur to dispose of Title Suit No. 80 of 2021 expeditiously. Mr. Banerjee, learned advocate appearing for the petitioner submits that the injunction application is pending from the year 2021. From the order-sheets appended to this application, this Court finds that on repeated occasions the hearing of the applications was adjourned on the ground of resolutions taken by the local bar association. However, it appears from the record that interlocutory applications, one under Order 39 Rule 7 and the other under Order 39 Rule 1 and 2 of the Civil Procedure Code are pending. Accordingly, CO 2034 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Division), 2 Durgapur to take up the hearing of the interlocutory applications, if the same are otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
