Kausik (Rejected) CRM (M) 1101 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Sainthia Police Station Case No. 311 of 2025 dated 13.07.2025 under Sections 103(1)/61(2) of BNS and Section 25/27 of Arms Act. And In the matter of : Saradamani Mridha Majumder ……Petitioner. Mr. Tapas Kr. Ghosh Mr. Tanmoy Chowdhury ……for the Petitioner. Mr. Gouranga Das, Ld. APP Mr. Somnath Bera ……for the State. Learned advocate appearing for the petitioner submits petitioner is in custody for about a year. She is a lady and is innocent of the accusations made against her and in spite of the same she has been suffering. Learned advocate appearing for the State has produced the case diary. I have taken into account the materials appearing in the case diary which reflects that the present accused/lady was in relationship with two persons, namely, Pijush and Rahul. There is specific accusation against the lady by the wife of the deceased. The deceased, namely, Pijush Kanti Ghosh, sustained bullet injury. There are materials to suggest the 2 complicity of the petitioner along with issue relating to culpability. Having considered that till date the case has not been committed to the Court of Sessions, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner in CRM (M) 1101 of 2026 is rejected. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
