Mahto, APP --- 04/06.04.2026 Heard the learned counsels appearing on behalf of the parties. 2. Learned counsel for the petitioner submits that the petitioner is in custody in connection with S.T. No. 184 of 2022 arising out of Bano (Girda O.P.) P.S. Case No. 32 of 2022 corresponding to G.R. No. 276 of 2022, registered under Section 302/34 of Indian Penal Code, now pending in the court of learned Addl. S.J.-I, Simdega. 3. Learned counsel for the petitioner submits that the petitioner is in custody since 12th July, 2022 and the petitioner has been falsely implicated in this case. 4. Learned counsel for the opposite party- State, on the other hand, has opposed the prayer and has submitted that the order impugned has been passed on 05.02.2026 and till that date, 4 out of 8 witnesses had been examined. He submits that a few more witnesses must have been examined by now and therefore, the petitioner may not be enlarged on bail. 5. After hearing the learned counsel for the parties and considering the fact that there is direct allegation against the petitioner and the trial appears to be at the fag end, this Court is not inclined to enlarge the petitioner on bail and hence, this bail application is rejected. 6. However, the State is directed to produce the remaining witnesses promptly before the learned trial court. 7. Learned counsel for the State is directed to communicate this order to the Director, Prosecution and also to the Superintendent of Police of the concerned district to ensure compliance. 2026:JHHC:9529 2 8.
