This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.64/2026 registered at Police Station Ramanujnagar, District Surajpur (C.G.) for the offence under Section 332 (B), 351 (2) and 64 (1) of the BNS, 2023. Case of the prosecution is that on 25.2.2026, at about 9.30 am, the present applicant entered the house of the victim and committed sexual intercourse with her by threatening to kill her by showing knife. Thereafter the concerned Police has registered the crime against the applicant. Hence the bail application. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the crime. It is submitted that there was affair between the victim and the present applicant and the victim is a married woman. On the date of the incident, when the wife of the applicant caught the victim with her husband red handed, the victim has made a false complaint against the present applicant. The applicant is in jail since 25.2.2026. Therefore, the applicant may be released on bail. 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that the applicant has committed sexual intercourse with the victim on the point of knife and the charge sheet has already been submitted against the applicant. Therefore, the present bail application may be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6.
Considering the facts and circumstances of the case, particularly considering the allegation levelled against the applicant that he
3 entered the house of the victim and committed sexual intercourse with her on the point of knife, this Court is not inclined to release the applicant on bail. 7. Accordingly, the bail application of applicant – Ravindra Khakha involved in Crime No.64/2026, registered at Police Station Ramanujnagar, District Surajpur for the offence punishable under Section 332 (B), 351 (2) and 64 (1) of the BNS, 2023, is rejected. -
