The petition under Section 528 Bharatiya Nagrik Suraksha Sanhita, 2023, seeks the following reliefs:- (i) Direction to official respondents No.2 and 3 to take action on representation dated 09.04.2026 which was marked to Economic Wing Cell vide complaint No.246 dated 18.06.2026 by the office of DCP, Panchkula; (ii) Direction to official respondents to protect life and liberty of the petitioner and his family members at the hands of the private respondents; 2. Learned counsel for the petitioner submits that petitioner purchased M/s Bajrang Screening Plant for Rs.85 lacs, which he had been operating since 29.09.2025. As per promise, the vendor did not get the MDL started leading to losses. Petitioner was confined in jail for some time, during which period private respondents illegally entered into the plant, SUMIT SINGLA 2026.07.06 19:05 I attest to the accuracy and integrity of this document CRM-M-35427-2026 (O&M) -2- threw out his manager, issued threats to him and took away all the material and goods lying in the plant. The matter was reported to the police but no action was taken. Learned counsel further submits that a complaint under Section 175(3) BNS was moved by the petitioner before the Court of learned Chief Judicial Magistrate, Panchkula for directing the police to register FIR but a long adjournment was granted in that case. Meanwhile, private respondents were issuing threats to kill and falsely implicate the petitioner and his family members. He further submits that petitioner again moved a representation to DCP, Panchkula which was marked to Economic Cell. 3. Notice of motion to official respondents only. 4. Ms. Kanica Sachdeva, DAG, Haryana accepts notice on behalf of official respondents. On instructions from ASI Rakesh Kumar, she submits that petitioner’s representation, Annexure P4 was received by the police on 09.04.2026. The matter was inquired into but no threat to petitioner’s life was perceived. The matter being civil in nature, case was closed. 5. Petitioner’s application for registration of FIR against private respondents is already pending before the Court concerned at Panchkula. Annexure P4 is his representation to SHO, Police Station Raipur Rani. It does not allege that private respondents were extending any threats to the petitioner or his family members. The police too has examined the representation and found no threat perception. In view of the response of learned State counsel and petitioner’s representation Annexure P4, no directions are required to be issued in the petition in the exercise of inherent jurisdiction of the Court.
