Learned advocate appearing for the petitioner submits that at the relevant time when the offence was committed, petitioner was in custody. No documents have been enclosed to substantiate such contention.
Learned advocate for the State submits that there are 5 criminal cases pending against the petitioner and the petitioner is a history-sheeter in the present case. The ATM machine was opened with a gas cutter and Rs. 21 Lakhs was removed from the ATM machine.
Having considered the criminal antecedents of the petitioner, the modus operandi followed in commission of the alleged offence and the fact that prima facie investigating authorities have been able to establish that the petitioner is a
2 habitual offender, I am not inclined to release the petitioner on bail.
Accordingly, prayer for bail of the petitioner in CRM (M) 1103 of 2026 is dismissed.
