And In Re : Mehtab Alam @ Aman ... Petitioner. Mr. Satadru Lahiri, Mr. Jyotirmoy Talukder, Mr. Manojit Debnath ... For the Petitioner. Mr. Sagar Saha, Ms. Nayana Mukhopadhyay ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 2 years 8 months. Even the earlier direction which was passed on 25.11.2025 in CRM (NDPS) 1501 of 2025 has not been complied with. Petitioner, as such, prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that 5 witnesses have been examined and prosecution intends to examine 3 more witnesses. The subject-matter of the case relates to alleged recovery of 64.344 kgs. of Ganja. In view of the present set of situation which was prevailing from the month of March 2026 to May 2026, a further opportunity is granted and prosecution is directed to complete examination of rest of the 2 witnesses within a period of three months from the next date fixed. In case the learned Trial Court finds that the evidence of the prosecution witnesses cannot be completed, even after the accused person cooperate with the progress of the case, then in that case, after the aforesaid time period is over, learned Trial Court will release the petitioner on bail on such terms and conditions as it deems fit and proper. At this stage, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1408 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
