Mr. Shivam Sharma, learned counsel for the petitioner through V.C. 2. By the instant petition, the petitioner is praying for the following relief. (i) Issue a writ, order or direction in the nature of mandamus directing the learned Civil Judge Senior Division Vikasnagar Dehradun to decide the Misc. case no. 23 of 2023 “ Manjeet Singh Saluja vs. Arun Kumar” pending before learned Civil Judge Senior Division Vikas Nagar, Dehradun . 3. The petitioner herein instituted a suit bearing O.S. No. 141 of 2017 but the same was dismissed for want of prosecution on 01.02.2021 and being aggrieved the restoration application was moved numbered as Misc. Case No. 23 of 2023 Manjeet Singh Saluja vs. Arun Kumar, which is still pending in the court of learned Civil Judge Senior Division Vikas Nagar, Dehradun. The relief as sought appears to be innocuous. 4. In such view of the matter, the instant writ petition is disposed of finally with the direction to the concerned court to decide the restoration application Misc. Case No. 23 of 2023 Manjeet Singh Saluja vs. Arun Kumar as early as possible preferably within six weeks from the date of production of certified copy of this order.
