PUBLIC PROSECUTOR The Court made the following: 3 THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI CRIMINAL PETITION NO: 4030 OF 2026 ORDER:- The Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), has been filed by the petitioners/A-1 to A-4 and A-7 to A-9 seeking anticipatory bail in connection with Crime No.40 of 2026 of Rallabudugur Police Station, Chittoor District. 2. Heard Sri K.G. Krishna Murthy, learned Senior Counsel assisted by Sri K. Raghu Veer, learned counsel for the petitioners, and the learned Assistant Public Prosecutor representing the respondent/State. Perused the record. 3. Learned counsel for the petitioners submitted that the petitioners are followers of Y.S.R. C.P. Party and the de facto complainant falsely foisted the case to harass the petitioners; that the Station House Officer, without conducting any enquiry or proper investigation, registered the F.I.R. under Section 109(1) of B.N.S.; that the de facto complainant filed a belated complaint on 05.04.2026 stating that the incident occurred on 02.04.2026 at about 11:00 P.M. 4. Learned Assistant Public Prosecutor opposed the bail. 5. Considering the submissions made and upon perusal of the material on record, and taking into account the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to petitioner Nos.1, 5, 6 and 7/ 4 A-1 and A-5, A-6 and A-7. However, anticipatory bail is granted to petitioner Nos.2, 3 and 4/A-2, A-3 and A-4 with the following conditions: (a) Petitioner Nos.2, 3 and 4/A-2, A-3 and A-4 are directed to surrender before the Station House Officer, Rallabudugur Police Station, Chittoor District, within a period of two (2) weeks from today and on such surrender, petitioner Nos.2, 3 and 4/A-2, A-3 and A-4 shall be released on bail on furnishing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) each with two sureties for a like sum each to the satisfaction of the Station House Officer, Rallabudugur P.S. Chittoor District. (b) Petitioner Nos.2, 3 and 4/A-2, A-3 and A-4 shall appear before the Investigating Officer once in a week i.e., every Sunday between 10.00 AM and 01.00 PM for three (03) months or till filing of the charge sheet, whichever is earlier. (c) Petitioner Nos.2, 3 and 4/A-2, A-3 and A-4 shall make themselves available for Investigation/interrogation by a police officer as and when required. (d) Petitioner Nos.2, 3 and 4/A-2, A-3 and A-4 shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. (e) Petitioner Nos.2, 3 and 4/A-2, A-3 and A-4 shall scrupulously comply with the above conditions and breach of any of them will be viewed seriously. The Prosecution is at liberty to move an application for cancellation of the bail. 6.
